Terms of Use

These Terms of Use ("Terms") govern your use of the dobudex mobile app and website (the "Service"), operated by MulletIQ B.V., Schieweg 152D, Rotterdam, the Netherlands (registered with the Dutch Chamber of Commerce (KvK) under no. 97102555, VAT no. NL867911050B01) ("we", "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

The Service

dobudex lets you scan real animals, identify them with AI, and collect them as pixel-art creatures. Identifications are generated automatically and may be inaccurate or incomplete; they are provided for entertainment and are not scientific determinations.

Eligibility and accounts

You must be at least 13 years old to use the Service. We ask for your birth month and year at sign-up to confirm this, and do not allow under-13s to use dobudex. If you are between 13 and the age of majority where you live, a parent or guardian should review and agree to these Terms with you. You can use dobudex as a guest or by signing in with Apple or Google. You are responsible for activity under your account.

Subscriptions and payments

• dobudex offers a free scan allowance and an optional auto-renewable subscription, dobudex Explorer, billed monthly, that provides up to 100 scans each month (the free allowance is smaller). Current limits and pricing are shown in the app before you purchase and on the store product page.
• Payment will be charged at the confirmation of purchase, to your Apple ID on the App Store or to your Google Play payment method on Google Play.
• The subscription renews automatically for the same period unless auto-renew is turned off before the end of the current period, and you are charged shortly before each renewal. On the App Store, auto-renew must be turned off at least 24 hours before the period ends, and renewal is charged within 24 hours of that point. On Google Play, you can cancel any time before the period ends, and Google may charge for renewal up to 48 hours beforehand.
• You manage or cancel your subscription, and turn off auto-renew, through your store's subscription settings after purchase: App Store account settings on iOS, or Google Play → Payments & subscriptions on Android.
• Any unused portion of a free trial, where offered, is forfeited when you purchase a subscription.
• Purchases are processed by the store you bought from. Apple handles refund requests for App Store purchases under its standard policies. Google handles refund requests for Google Play purchases made within the last 48 hours; after that Google directs you to us, and we will consider the request under applicable policy and law. Where a statutory right of withdrawal applies, it may be limited once digital content has been supplied.

If you installed the app from the App Store, your use of it is also governed by Apple's Licensed Application End User License Agreement (the standard EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula. If you installed it from Google Play, these Terms are the licence for the app; your use of the Play store itself is governed separately by your agreement with Google.

Your content

You keep ownership of the photos you capture. You grant us the limited license needed to upload, store, and process them to provide the Service (including AI identification and image generation), as described in our Privacy Policy. Do not scan content you do not have the right to capture, do not capture identifiable people without their permission, and do not use the Service for unlawful purposes.

Community and social features

dobudex includes optional social features. Your chosen username, your avatar creature, and your collection counts are visible to other users on the leaderboard and to friends you connect with. Friend connections are mutual: they can only be made with an invite code you choose to share, and the code's owner must approve each request before the two of you become friends. There is no messaging between users, and your scan photos and locations are never shown to other users.

Anything other users can see must be appropriate for a general audience. In your username or avatar, do not include content that is unlawful, hateful, harassing, threatening, sexually explicit, or otherwise objectionable; do not impersonate others; and do not include contact details or other personal data (yours or anyone else's).

We enforce this with automated filtering and human review of reports. You can report or block any user from within the app; blocking removes the connection and hides you from each other. We act on credible reports, and we may reset usernames, remove avatars, restrict social features, or suspend or terminate accounts that violate these rules, in line with the Termination section below. Acceptable use

Do not misuse the Service: no attempting to break, overload, reverse engineer, or abuse it, and no uploading unlawful or harmful content.

Disclaimers

To the extent permitted by law, the Service is provided "as is" without warranties of any kind. We do not guarantee that identifications are accurate or that the Service will be uninterrupted or error-free. This does not affect any mandatory statutory rights or remedies you have as a consumer.

Limitation of liability

To the maximum extent permitted by law, dobudex is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including your mandatory rights as a consumer.

Termination

You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate access if these Terms are violated.

Changes

We may update these Terms as the Service evolves. We will post material changes here with an updated "Last updated" date and give reasonable advance notice where required. Continued use of the Service after changes take effect constitutes acceptance.

General

These Terms, together with our Privacy Policy and, for App Store installs, Apple's standard EULA, are the entire agreement between you and us regarding the Service. Your separate agreements with Apple or Google govern your use of their stores and are not part of this one. If any provision is held unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign them without our consent.

Governing law

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-law rules, and the competent courts of the Netherlands have jurisdiction. If you are a consumer, this does not deprive you of the mandatory protections of the law of your country of residence, and you may also bring proceedings in your local courts where applicable law so provides.
